Please note that while text messaging opt out/unsubscribe requests are processed immediately upon our receipt, we are not responsible for any carrier delays. Carriers are not liable for delayed or undelivered messages. Additionally, please allow up to 10 business days to process marketing email opt out/unsubscribe requests. If you make a purchase through our Website or stores, you may opt back in to marketing communications from us until you opt out/unsubscribe once again. We are not in the business of selling personal information, but such information may be shared or disclosed in limited circumstances to provide customers certain additional services such as interest-based advertising, for products or services that may be beneficial for our customers, third party shipment carriers such as USPS or UPS to deliver products to you, and credit card information to processors and issuers to help process your orders.

It is important that you provide a valid email address in order for us to be able to process your request.

We will respond to your rights request within 45 days, though in certain cases we may inform you that we will need up to another 45 days to act on your request. If we suspect fraudulent or malicious activity on or from your account, we will delay taking action on your request until we can appropriately verify your identity and the request as authentic. Also note that each of the rights are subject to certain exceptions. If you believe our response to your rights request is insufficient, you can appeal our decision by contacting Privacy Appeals Officer at innisfree@apus.amorepacific.com and we will inform you of our final decision within 45 days.

We reserve the right to decline to process, or charge a reasonable fee for, requests from a US resident that are manifestly unfounded, excessive, or repetitive.

Targeted Advertising

“Targeted advertising” as used in this Privacy Notice means the disclosure of personal  information to a third party for behavioral advertising. An example of this is displaying advertisements to a US resident where the advertisement is selected based on personal information obtained from that person’s activities over time and across nonaffiliated websites or online applications to predict such person’s preferences or interests. We share some personal information for behavioral advertising. You can opt out of the sharing of your personal information for targeted advertising by submitting a rights request as described above.

Rights Provided to California Businesses and Service Providers with whom we have Business Relationships

When you engage in a business relationship with us, we will collect and process your personal information as described above and for the specific purposes detailed in our agreed to business terms. Namely, we use your personal information for business purposes such as to perform and provide services on behalf of the business. We do not sell or share the information you provide to us, but we may disclose such information to other service providers from time to time as necessary. This Privacy Notice does not override any specific contracts agreed to by the parties, and relationships may be governed by further privacy agreements. If you are engaging with us on behalf of others in your company or otherwise providing the personal information of others, by engaging with us, you acknowledge and agree that you have the consent of the data subject.

Rights Regarding Sensitive Personal Information

Virginia, Colorado, and Connecticut Residents: Virginia, Colorado, and Connecticut residents are provided the right to opt-in to the collection/processing of sensitive personal information. However, We only collect sensitive personal information in the form of account log-in and password, which you voluntarily provide to us when you create an account.  

California Residents: We only collect sensitive personal information to fulfill or meet the reason you provided the information. Therefore, we do not offer a right to limit. If you exercise your right to delete sensitive personal information from our systems, it may limit our ability to provide the products and services where such information is necessary and will be subject to the limitations referenced in our retention practices mentioned above.

Authorized Agent Requests

You may designate an authorized agent to make a rights request on your behalf. Your authorized agent may submit such a request by following the same method described above. We may require verification of your authorized agent in addition to the information for verification above for US residents and households.

Financial Incentives

We may offer you certain financial incentives that can result in different prices, rates, or quality levels. Any permitted financial incentive we offer will reasonably relate to your personal information's value. When we offer financial incentives, we request identifiers, though we may also request additional personal information such as name, email, password, shipping address, cell phone number, and date of birth. We share this information with our processors, affiliates, analytics and advertising partners, and business partners. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time. We calculate the value of the financial incentive by using the expense related to the offer, and the value of your personal information is the value of the offer presented to you. We currently provide the following financial incentives when you sign up for texts here, rewards here, or otherwise subscribe to our emails and texts. These financial incentives require the use of personal information for targeted advertising purposes.

12. Nevada Privacy Rights

We do not sell personal information to third parties. Nonetheless, Nevada consumers have a right to submit a request to opt-out of sale of personal information, referred to under the Nevada Privacy Law as "covered information." Upon receipt of a verified request, both as to the submission and the identity of the consumer, we will ensure that no covered information, as defined under the Nevada Privacy Law, is sold. We will further notify the customer within 60 days after receipt that the request has been processed. At this time, Nevada residents can only submit this request by contacting us via email at innisfree@apus.amorepacific.com.
